DarkTrafficIQ End User License Agreement (EULA)

1. License Grant

Subject to your compliance with this EULA, HACC grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and run one copy of the Software on each mobile device you own or control, solely for your personal, non-commercial use of the Service.

2. Restrictions

You will not:

• Copy, modify, translate, or create derivative works of the Software, except as expressly permitted by law that cannot be waived;
• Reverse-engineer, decompile, or disassemble the Software, except to the limited extent applicable law expressly permits;
• Rent, lease, lend, sell, sublicense, or transfer the Software;
• Remove or alter any proprietary notices on the Software;
• Use the Software in any way that violates law, infringes rights, or breaches the Terms of Service.

3. Updates

We may release updates, patches, or new versions, which may be installed automatically by your device’s operating system. Updates may add, modify, or remove features.

4. Ownership

The Software (including all copies, modifications, and derivative works) is and will remain the property of HACC and its licensors. All rights not expressly granted are reserved.

5. Apple-Specific Terms (iOS)

If you obtained the Software from the Apple App Store, the following additional terms apply and prevail over any conflicting provision of this EULA with respect to your iOS use:

• This EULA is between you and HACC only, not with Apple. Apple is not responsible for the Software or its content.
• Your license to use the Software is limited to use on Apple-branded products you own or control, and as permitted by the Usage Rules of the Apple Media Services Terms.
• Apple has no obligation to furnish any maintenance or support services with respect to the Software.
• If the Software fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the Software (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the Software.
• HACC, not Apple, is responsible for addressing any claims relating to the Software, including product-liability claims, claims that the Software fails to conform to applicable legal or regulatory requirements, and claims arising under consumer-protection or similar legislation.
• HACC, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual-property infringement claim relating to the Software.
• You represent that (i) you are not located in a country that is subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and (ii) you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you.

6. Google-Specific Terms (Android)

If you obtained the Software from Google Play, your use is also subject to the Google Play Terms of Service. Google is not responsible for the Software, this EULA, or any claims related to the Software.

7. U.S. Government End Users

The Software is “Commercial Computer Software” and “Commercial Computer Software Documentation” as defined in 48 C.F.R. § 2.101. Use, duplication, or disclosure by U.S. Government end users is governed solely by the terms of this EULA.

8. Export Controls

You agree to comply with all applicable export-control laws and regulations of the United States and other relevant jurisdictions. The Software may not be exported, re-exported, or transferred in violation of such laws.

9. Disclaimers and Limitation of Liability

The disclaimers in Section 10 and the limitations of liability in Section 11 of the Terms of Service are incorporated into this EULA by reference and apply to the Software.

10. Termination

This EULA terminates automatically if you breach it. Upon termination, you must cease all use of the Software and remove it from your devices. Sections 4, 5, 8, 9, and 10 survive termination.
