DarkTrafficIQ Terms of Service

Effective Date: May 5, 2026

These Terms of Service (“Terms”) form a binding agreement between you and The HACC Group, Inc. (“HACC”, “we”, “us”) and govern your use of the DarkTrafficIQmobile application and related services (the “Service”). Please also read our Privacy Policy, which is incorporated into these Terms by reference.

By creating an account, downloading the app, or using the Service, you accept these Terms. If you do not accept them, do not use the Service.

1. Eligibility

You must be at least 13 years old (16 in the EEA/UK) to create a DarkTrafficIQ account, and at least 18 (or the age of legal majority where you live) to purchase a paid subscription. By using the Service you represent that you meet these requirements and that you have authority to add to DarkTrafficIQ each phone number you protect.

2. The Service

DarkTrafficIQ analyzes inbound telecommunications traffic associated with phone numbers you choose to protect, scores risk based on metadata such as origin geography, carrier, time, and pattern, and surfaces alerts to you in-app and via push notifications. The Service operates on telecommunications metadata (Call Detail Records); it does not record the audio content of your calls.

The Service is provided as software-as-a-service. We may add, modify, or discontinue features at our discretion; if we make a material adverse change, we will give reasonable notice.

3. Your Account

  • You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
  • You agree to provide accurate, current information and to keep it up to date.
  • You will promptly notify us at support@trafficiq.ai of any unauthorized use of your account.
  • We may suspend or terminate accounts for violations of these Terms or to protect the Service.

4. Subscriptions, Billing, and Refunds

4.1 In-App Purchases

DarkTrafficIQ subscriptions are offered as auto-renewable subscriptions sold through the Apple App Store (iOS) or Google Play (Android). Subscription tiers, durations, and pricing are displayed at the point of purchase and may vary by region.

4.2 Auto-Renewal

  • Payment is charged to your Apple ID or Google account at confirmation of purchase.
  • Your subscription automatically renews for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Renewals are charged within 24 hours before the end of the current period.
  • You can manage and cancel auto-renewal in your device’s account settings (Apple ID Settings → Subscriptions, or Google Play → Subscriptions).

4.3 Free Trials and Promotional Offers

If a free trial is offered, any unused portion is forfeited when you purchase a subscription. After the trial, the subscription auto-renews at the standard price unless cancelled at least 24 hours before the trial ends.

4.4 Refunds

All sales are processed by Apple or Google, and refund eligibility is governed by their respective terms (Apple Media Services Terms; Google Play Terms of Service). Please direct refund requests to the platform that processed the purchase.

4.5 Price and Plan Changes

We may change subscription prices and plan contents. Changes apply to renewals after we provide notice in-app, by email, or as required by Apple/Google. If you do not agree to a price change, cancel before the next renewal.

5. License

Subject to these Terms, HACC grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the DarkTrafficIQ app on devices you own or control, solely for your personal, non-commercial use of the Service.

6. Acceptable Use

You agree not to:

  • Use the Service to violate any law or third-party right (including privacy, telecommunications, and wiretap laws);
  • Add to DarkTrafficIQ a phone number you do not own or are not authorized to monitor;
  • Reverse-engineer, decompile, or attempt to extract the source code of the app, except where applicable law expressly permits it;
  • Interfere with, probe, or disrupt the Service, our infrastructure, or other users;
  • Use the Service to send spam, phishing content, or malware;
  • Resell, sublicense, or commercially exploit the Service without our written consent;
  • Use automated means (bots, scrapers) to access the Service except via documented APIs and within their rate limits.

7. Your Content; Feedback

You retain ownership of content you submit (such as the phone numbers you protect or files you upload to support tickets). You grant HACC a worldwide, royalty-free license to host, store, transmit, display, and process that content solely as needed to operate the Service. If you send us feedback or suggestions, you agree we may use them without obligation to you.

8. Intellectual Property

The Service, the DarkTrafficIQ name and logo, and all related software, content, and trademarks are owned by HACC or its licensors and are protected by intellectual-property laws. Except for the limited license in Section 5, no rights are granted to you.

9. Third-Party Services

The Service integrates with third-party services (Apple, Google, RevenueCat, push notifications, GeoIP providers, infrastructure providers). Your use of those services is governed by their own terms, and HACC is not responsible for them.

10. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, HACC disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure, or accurate.

DarkTrafficIQ is a risk-analysis and alerting tool. It is not a substitute for emergency services and is not designed to detect or block all malicious activity. You remain responsible for your own security decisions and for contacting law enforcement or your carrier where appropriate.

11. Limitation of Liability

To the maximum extent permitted by law, HACC and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or related to your use of the Service, even if advised of the possibility.

HACC’s aggregate liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, or (b) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the smallest extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless HACC and its affiliates from any claim, damages, liability, and expense (including reasonable attorneys’ fees) arising from (a) your use of the Service, (b) your violation of these Terms, or (c) your infringement of any law or third-party right.

13. Termination

You may stop using the Service at any time and may delete your account as described in our Account Deletion page. We may suspend or terminate your access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination (such as Sections 7–13, 15, and 16) will survive.

14. Apple App Store EULA — Additional Terms (iOS)

If you obtained the app from the Apple App Store, the following terms also apply, and they prevail over any conflicting provision of these Terms with respect to your iOS use:

  • These Terms are between you and HACC only, not with Apple. Apple is not responsible for the app or its content.
  • The license granted to you is limited to use of the app on Apple-branded devices that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms.
  • Apple has no obligation to provide any maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are HACC’s sole responsibility.
  • HACC, not Apple, is responsible for addressing any claims you or a third party have relating to the app, including product-liability and IP-infringement claims.
  • You represent that you are not in a country subject to a U.S. embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules. The exclusive forum for disputes is the state or federal courts located in San Francisco County, California, and you and HACC consent to personal jurisdiction there. Where required by law, this clause does not deprive you of mandatory consumer protections in your country of residence.

16. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice in-app, by email, or as required by law before they take effect. Continued use of the Service after the effective date constitutes acceptance.

17. Miscellaneous

  • Entire agreement: these Terms (with the Privacy Policy and any in-product notices) constitute the entire agreement between you and HACC regarding the Service.
  • No waiver: our failure to enforce a right is not a waiver of it.
  • Severability: if a provision is unenforceable, the remaining provisions remain in effect.
  • Assignment: you may not assign these Terms without our consent; we may assign them in connection with a corporate transaction.

18. Contact
